Hi Guys

What's your take on assignment 1? Are we required to mention Steyn v LSA or merely on the case that is relevant (Sonap?). In my view, the Steyn case is not relevant to the set of facts, but Sonap maybe?

I am of the opinion that it has to be the Reliance theory. Still not convinced that it is iustus error, but still doing my "homework" on that, but see point 6 page 48 of study guide?

Yeah, I saw that. I think you're right.

In Steyn, reliance was applied.
Iustus error: In that ANSWER, it says that court did not apply iustus error approach because there wasn't a clear, objective agreement between the parties - like a signed contract.

In our questions, there is a verbal contract (where the "lie" took place), and then a signed contract. So iustus error could be applied.

In ch3, pg107 of the textbook (2nd ed), Sonap is discussed - which is a bit more relevant to our situation:
Reliance theory is used to determine whether there is a contract, and then he formulates a test for the the reliance theory (and iustus error). This test is called the Sonap test.
There's a duty to speak; you must make sure that the expressed intention is the actual intention, absence of reasonable belief in consensus.

The reliance theory is the primary approach to be adopted when dealing with dissensus. The iustus error approach is just an application of the reliance theory and more specifically an indirect application.

But what really confuses me is the advertisement (which was false), the verbal contract (where Peter's intention was made clear), and then John's silence.

Like, what? There are so many "moving parts" to this.

I suspect I'm making it toooooooo complicated.

What do you think?

No, it is a difficult one with many moving parts, as you say. I thought that I was ready to tackle this, but I am not, having read and re-read the judgment and articles over and over today....

I am leaning towards the Reliance theory and think that the fact that there was no consensus, but rather dissensus, is also an important angle to look at. Obviously the question of what a reasonable man would have done is also important, or at least so I think at this stage....

Okay. I read the entire Steyn case and read the entire Sonap case.

It looks like we're dealing with reliance and iustus error, consensus/dissensus and a reasonable man.
Indirect application of reliance theory.

Steyn lost - coz he didn't educate himself, he didn't ask for clarification.
Sonap won the appeal, because there was a mistake and the property owner knew there was a mistake and didn't speak up.

What do you think?

Hi guys im still trying to figure out what tye real issue is with regards to assignment one....seeing as it is not misrepresentation could this be a common mistake as both parties were mutually unaware of rhe mistake however it was later discovered thus not leading to dissensus but nonetheless leading to the contract being void?
