What would happen when there's two parties after theft regarding a crossed cheque marked non-negotiable?
Will both of them be liable to true owner as possessors?
Or only the one who deposits the cheque into his bank account?

81 True owner of stolen or lost crossed cheque marked 'not negotiable' entitled to
compensation from certain subsequent possessors
(1) If a cheque was stolen or lost while it was crossed as authorized by this Act
and while it bore on it the words 'not negotiable', and it was paid by the bank upon which
it was drawn, under circumstances which do not render such bank liable in terms of this
Act to the true owner of the cheque for any loss he may sustain owing to the cheque
having been paid, the true owner shall, if he suffered any loss as a result of the theft or
loss of the cheque, be entitled to recover from any person who was a possessor thereof
after the theft or loss, and either gave a consideration therefor or took it as a donee, an
amount equal to the true owner's said loss or the amount of the cheque, whichever is the
lesser.

C, an employee of A , persuades A that he owes B a certain sum of money. However, B does not exist.
A is unaware of this and draws a cheque in favour of B. C forges B's signature on the back of the cheque
and delivers it to X in settlement of his debt. Is X a holder, holder in due course or possessor?

This example is making me spin, anyone can assist?

He cant be a holder because of forged endorsement, and also not a holder in due course.
But this should be a bearer cheque because its made to a non-existent person.

My head is also spinning!

I think he is a holder in due course because:

The fact that the cheque is payable to a fictitious or non-existing person makes it a bearer cheque.
A holder is the payee or indorsee of a bill who is in possession of an order instrument or the bearer in possession.
Because it's a bearer cheque any person in possession of the cheque is a holder. X is in possession of the bearer cheque and thus its holder.
A holder in due course is a holder who complies with all the requirements as per section 27. As X complies with all the requirements as per sec.27, he is a holder in due course.

Bearer cheques are negotiated by mere delivery. Endorsements are unnessary for negotiation.


Don't know how I'm going to pass this module.
